Welcome to Sri Lanka Car with Driver Hire (the “Platform”). By accessing or using our Platform, you agree to comply with and be bound by the following terms and conditions (the “Terms”). Please read these Terms carefully before using our Platform. If you do not agree with these Terms, you must not use the Platform.

1. Acceptance of Terms

By using the Platform, you agree to be bound by these Terms and any additional terms and conditions that are referenced herein or that otherwise may apply to specific sections of the Platform, or to products and services that we make available to you through the Platform.

2. Description of Services

Sri Lanka Car with Driver Hire provides a platform that connects tourists with drivers in Sri Lanka. Tourists can use the Platform to find and book drivers for their transportation needs. The Platform is free for tourists to use, while drivers are charged an 8% commission on each booking.

3. User Responsibilities

Tourists:

  • Ensure that all information provided during the booking process is accurate and up-to-date.
  • Comply with all applicable laws and regulations when using the Platform.
  • Treat drivers with respect and courtesy.

Drivers:

  • Provide accurate and complete information during the registration process.
  • Maintain the highest standards of service and professionalism.
  • Comply with all applicable laws and regulations, including possessing valid licenses and insurance.
  • Pay an 8% commission on each booking made through the Platform.

4. Booking and Payment

  • Tourists can book drivers through the Platform at no cost.
  • Drivers are required to pay an 8% commission on each booking, which will be deducted automatically from the payment received from tourists.
  • Payments are processed through third-party payment providers, and the Platform is not responsible for any issues related to payment processing.

5. Cancellations and Refunds

  • Tourists may cancel bookings in accordance with the cancellation policy outlined at the time of booking.
  • Drivers may also cancel bookings but must provide sufficient notice to the tourists and the Platform.
  • Refunds, if applicable, will be processed according to the specific cancellation policy associated with the booking.

6. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Sri Lanka Car with Driver Hire or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our prior written permission.

7. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. We make no warranties, either express or implied, about the Platform or its content. To the fullest extent permitted by law, Sri Lanka Car with Driver Hire disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

In no event shall Sri Lanka Car with Driver Hire be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Indemnification

You agree to indemnify, defend, and hold harmless Sri Lanka Car with Driver Hire, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) relating to or arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within [Insert Jurisdiction] for the purpose of litigating all such claims or disputes.
